New Oregon Law About Dogs in Cars

Oregon became the 11th state to pass a “good tactical law” to protect dogs in hot cars. 

On June 22, 2017, as the heatwave swept across Oregon over 100 degrees over the weekend, Governor Kate Brown signed Law House Bill 2732 to protect stray dogs and children in hot cars. Oregon is the 11th state to pass such a “good tactical law,” only this year.  

 

Oregon’s new law about dogs in cars, which immediately went into effect, enhances the protection of vulnerable fellow animals by providing that no one – not just law enforcement – can be intimidated by some force or other means by the fear of a criminal.


A motor vehicle can be inserted to evacuate a child or pet without stopping. Or civil responsibility until specific requirements are met. 

To meet these needs, a person must: 

  • There is a strong belief that there is a serious risk of harm to an animal or a child. 

  • Notify law enforcement or emergency services before or soon after entering the vehicle. 

  • Use the minimum force required to enter the car. 

  • Stay with the animal or child until law enforcement, emergency services, or the car owner or operator arrive. 


Over the past two years, there has been a steady increase in the number of states approving legislation to address the issue of companion animals surviving in hot cars, a growing subset of regular citizens (law enforcement) saves the animals.  

 

In 2017, similar “good tactical laws” were passed in ArizonaColorado, and Indiana. Of the additional seven states that authorize citizens to help animals trapped in vehicles in dangerous weather conditions, six laws were passed in 2016 (California, Florida, Massachusetts, Ohio, Wisconsin, and Vermont). Someone passed their law in 2015 (Tennessee).  

 

H.B. According to a report from the Oregon State Legislature Senate Majority Office, 2732 were passed with a third-party Girl Scout Troop’s help. Their members were instrumental in introducing and lobbying the bill.

Why Is This Legislation Necessary?

Although media coverage and outreach campaigns by various groups, including the Animal Legal Defense Fund, have increased public awareness of the dangers of leaving children or animals in hot cars. 

 

Many are unaware of the potential threat, as evidenced by the number of animals that still die each year in hot cars. 

 

For example, although it has been shown to have little effect on a car’s internal temperature, many people find it relatively safe to leave windows open on a hot day. 

 

Or not realizing how quickly the temperature inside the car can rise to dangerous levels even when the outside temperature is below 70 degrees. 

Even on a hot day in a demonstration, some people do not realize the dangers of leaving animals in the car. Just a day after Oregon’s new law went into effect, a good strategist used it to save a dog. 

 

The temperature outside downtown Portland was 89 degrees when Shona Hurch fell into a fast car, the windows of which were smashed, and Monrov blew up just an inch to save a small dog trapped in Crete. 

 

She tried to find the owners, called the police (who said they would send someone, but it might be a while), and tried to take advantage of the car alarm.  

Half an hour after seeing the barking dog, which had now stopped barking and looked distraught, she managed to break the window and remove the dog with the help of passersby.

The Disability Act with the Americans (ADA) clearly defines a service animal as an animal that is individually trained to work or perform work for people with disabilities. They are not pets.

The ADA does not cover dogs or therapy animals whose job is to provide comfort or emotional support. Your dog is not allowed to enter the store if you have a doctor’s clearance certificate. Other laws protect owners’ rights to use them when it comes to air travel or housing. 

 

Service dogs do not need identification. 

Bests, tags, or other accessories are not legally required or are not recognized for service dogs.

He estimates Multnomah County has a track record of about 142,000 dogs and 195,000 cats. The county has a limit of four animals per household, which is shared by many communities. You may have six or seven dogs in Oregon, but if you do, you’re [literally] a canal, Oswald says. And, in Multnomah County, you can’t legally run a canal in a residential zone. 

 

In many cities and counties, zoning codes form the backbone of legal pet boundaries. Pet owners are excited about the right to want as many animals as possible, while the zoning board also intends to maintain people and pets’ density level. 

 

Oswald says such limits are more likely to be imposed in high-density areas. Animal control is one of the items that need codes so that everyone can accord their living space. 

 

If you live in a huge frequency city like New York, you’ll have to get codes to keep the level up – noise levels, waste levels, all kinds of levels.” 

Some groups have been successful in removing ordinances and ordinances that affect pet communities.  

 

According to Norma Wolf, editor of Kansas Major Publications and president of the Ohio Valley Dog Owners Group, most pets are pushing the boundaries under the fundamental misconception that more pets mean more hassle. An irresponsibly owned dog can be more of a problem than five or six dogs adequately cared for. 

 

In Hamilton County, Ohio, County Auditor Dusty Rhodes lives in a community with no pet limits. With 840,000 people, there will be some who are careless keepers of dogs, Rhodes said. If a bill is going to be passed saying that you cannot keep three cats or dogs, what will be the method of those qualified for this order?  

 

When local governments can’t comply with laws governing pet care quality, they often use pet limits as an immediate correction, but this is usually not a real solution. 

 

Patty Strand, president of the National Animal Interest Alliance (NAIA), says governments should enforce negligent and disturbing laws rather than setting pet limits. “
